Registering accounts and reporting regimes of foreign-invested enterprises

The importance of foreign-invested enterprises in Vietnam has been increasingly affirmed and has contributed to the growth of national GDP since 2010. Therefore, the law has specific regulations for this type of business when carrying out these business activities in the territory of Vietnam. Accordingly, after a foreign-invested enterprises have registered for an investment registration certificate (IRC) and an enterprise registration certificate (ERC), foreign-invested enterprises should pay attention to register an account and make a report. Through the following article, Nghiep Thanh Law will guide readers to carry out those activities.

After the foreign-invested enterprises are granted IRC and ERC, the foreign-invested enterprises need to implement the reporting regimes on investment, business activities of the enterprises in the territory of Vietnam. Accordingly, the regime of reporting investment in Vietnam is provision of documents related to investment activities to the investment registration agency including the Department of Planning and Investment and the Management Board of the Industrial Park, export processing zones, high-tech zones and economic zones to ensure the effective management, administration and supervision in the field of investment.

* The foreign-invested enterprises have responsibility to report on the implementation of investment projects, including the following contents:[1]

– Investment capital, investment results;

– Employees;

– Payment to government budget, investment in R&D, environmental protection;

– Other professional indicators.

* The regime of reporting is done periodically:[2]

– Quarterly reports: carry out by the 10th of the first month of the quarter succeeding the reporting quarter;

Form of the quarterly report:

– Annual report: carry out by March 31 of the next year;

Form of the annual report:

* The report form must be submitted online through the National Investment Information System[3]. In case the business doesn’t have an account, follow these 3 steps to open an account:

Step 1: Fill in the registration form to create an account (Biểu mẫu phiếu đăng ký tài khoản doanh nghiệp)

Step 2: Submit to the investment registration agency. After that, the account information and access password will be sent to the email that the enterprises have provided.

Step 3: After having the account, the foreign-invested enterprises carry out to report periodically with the investment registration agency.

Note: If the foreign-invested enterprises have many investment projects, the account will be transferred to the first project, for other projects, the enterprises must provide a sperate account to report to the investment registration agency.

So, the foreign-invested enterprises need to register the account (If you haven’t) to report periodically to the investment registration agency and local statistical office.
