Before recruiting foreign labor, Enterprises must announce Vietnamese labor recruitment

This is a new detailing of the law for recruiting foreign labor in Vietnam starting from January 1, 2024. Enterprises are only allowed to recruit foreign labor after posting announcements of Vietnamese labor recruitment on the official Website portal of the Ministry of Labor – Invalids and Social Affairs of Vietnam or on the Website portal of the labor service center established by the People’s Committee[1].

The announcement of recruitment Vietnamese labor shall:

– Job position

– Job description

– Quantity of workers

– Required qualifications and experience

– Salaries

– Working time

– Working location.

The announcement of recruitment must be posted within at least 15 days from the expected date of enterprise sending an explanatory report to use labor.

Therefore, starting from January 1, 2024, enterprises need to pay attention three timelines when planning to recruit foreign labor before proceeding with the procedures for a labor license, as follows:
